In order to ensure the advanced development of Alatau
city and stimulate the sustainable growth of the innovation-oriented economy of
the Republic of Kazakhstan, it is necessary to consolidate in constitutional
law the legal foundations that provide for: 1) the formation of a special
institutional (regulatory, legal, and organizational) environment that promotes
the accelerated socio-economic development of Alatau city through investment in
perspective business sectors and the introduction of innovations; 2) the
provision of a qualitatively new level of institutional framework for
attracting and protecting any private investment in the development of Alatau
city; 3) applying leading international management approaches and practices,
including the specific features of SEZs,“ according to the regulatory policy
advisory document for the draft Constitutional Law ”On the Special Status of
the Alatau city".
"An
important stage in the implementation of the project was the creation of the G4
City Special Economic Zone (SEZ) on March 15, 2023, renamed the Alatau SEZ on
December 26, 2023. By Decree of the President of the Republic of Kazakhstan No.
432 of January 9, 2024 “On changes in the administrative-territorial structure
of the Almaty region,” the city of regional significance Alatau was formed, and
by resolution of the government of the Republic of Kazakhstan No. 388 of May
17, 2024, “On the master plan of the Alatau city in the Almaty Region
(including the main provisions),” its master plan, based on the G4 City
concept, was approved. Thus, the development of Alatau city was carried out
within the framework of the Alatau SEZ and the master plan, in accordance with
which the planned territory was assigned a new status," the document says.
The
following conditions, which ensured the effectiveness of the legal regime, were
identified as key factors in the center's success:
1) the
constitutional law provides rules for the functioning of the legal regime that
are understandable to foreign investors, including certain exceptions to the
legislation;
2) the
constitutional law grants the center's authorities the right to independently
issue acts regulating specific issues;
3) the
hierarchy of the constitutional law in the system of normative legal acts,
which is expressed in its higher legal force compared to the codes and laws of
the Republic of Kazakhstan.
"In
view of the above, in order to ensure the advanced development of Alatau city
and stimulate sustainable economic growth, the formation and regulation of
special status is only possible through the adoption of a separate
constitutional law that will consolidate the features of the legal regime,
local government regime, and the functioning of a special legal regime that
goes beyond the established framework of regulation of relations and public
administration provided for by the laws and codes of the Republic of
Kazakhstan," the statement said.
